BFKN attorneys Robert D. Nachman, W. Scott Porterfield, John M. Geiringer, and Caroline Sear Rummans recently filed an amicus brief in the federal Sixth Circuit Court of Appeals on behalf of The American Association of Bank Directors (AABD). The case, Calcutt v. FDIC, involved enforcement actions taken by the Federal Deposit Insurance Corporation (FDIC) against someone who has served as a bank director and officer. The amicus brief questioned the procedural and substantive decisions made by the FDIC in the case, and expressed concerns that such decisions would improperly elevate the personal liability and reputation risks of all bank directors. John Geiringer serves on the AABD’s Task Force on Mitigating Director Liability.
