Overview
The Trademark Trial and Appeal Board (TTAB) has dismissed an opposition filed by the popular energy drink, Monster Energy, against applications filed by Cavaliers Hockey Holdings LLC, operator of the AHL professional hockey team the Cleveland Monsters. The opposition was against eight trademark and service applications to register the Cleveland Monsters team logo and design in connection with professional hockey services, related promotional goods, and merchandise.
In a 77-page opinion, the TTAB dismissed Monster Energy’s consolidated opposition after a full trial on the merits and agreed with the hockey team’s argument that the marks were unlikely to cause confusion.
